    Contested estate litigation is extremely costly, time-consuming, stressful and destructive of family relationships. Lawyers representing the parties in dispute almost always attempt to negotiate an agreed settlement, if at all possible, to mitigate these effects. However, the parties are not always “rational” in the narrow sense of assessing their own best interests, as judgement can be skewed by emotion. It’s not always about the “money” – it’s often about the interpersonal dynamics of parent and child, step-parent and step-child, or sibling rivalry going back to childhood. What are the alternatives to a formal trial in the Probate Court or in the Supreme Court? What options exist to have a Judge as mediator? What avenues are open to involve a private mediator? In either case, what professional skills are appropriate? Should mediation be mandatory for most family disputes? What are the advantages and disadvantages of the various approaches to settlement?

Comprehensive income planning involves an integrated approach using four distinct planning channels. This session will discuss how each of these areas function separately and on an integrated basis.
