This topic will be presented as a discussion of case studies and case law to outline a variety of issues around insolvent estates, including the following:
- Advice to clients to minimize estate for tax and probate, privacy, etc. could leave estate without sufficient assets to pay taxes and expenses of deceased.
- No withholding on RSP when there is a direct beneficiary. Joint liability to CRA?
- S.160, What can CRA do and not do? Preferred creditor?
- Who represents clients in these kinds of “cases”? Who is the client/who pays?
- Rules in Probate Act for insolvent estates
