  • October 27, 2009National Webcast: Tax Court of Canada Cases - Garron Family Trust and Antle

    STEP Canada is pleased to announce its inaugural cross-country webcast to be held on Oct. 27, 2009. The topic of this premiere event will be the impact of the recently released Tax Court of Canada trust decisions, Garron Family Trust v. The Queen 2009 TCC 450 and Antle v. The Queen 2009 TCC 465.

    If these decisions are upheld on appeal they will have a significant effect on how existing trusts are structured. The Garron decision centered on the issue of tax residency of a trust. In Antle the Court reviewed the structure of a trust established for tax avoidance purposes by analyzing the “three certainties” required to establish a trust.

    STEP Canada is bringing together a panel of trust experts to provide commentary and field questions about the potential impact of these TCC decisions. The event will be broadcast from Calgary’s Metropolitan Conference Centre and webcast across the country on Tuesday, Oct. 27th from 11-2 ET.

    Featured Panelists:

    • Craig Jones, Felesky Flynn LLP, Calgary
    • Cindy Radu, CIDEL Trust Company, Calgary
    • David Thompson, Thorsteinssons LLP, Vancouver
    • Prof. Lionel Smith, McGill University Faculty of Law, Montreal
    • Paul LeBreux, Global Tax Law PC, Toronto (Moderator)

    Registration, in-person or via the web, is to be paid on an individual basis. A link to the webcast will be sent via email to all online attendees. We assume that some online attendees will gather together to watch the webcast – using only one of attendee’s links. • November 11, 2009National Webcast (Archived Replay): Tax Court of Canada Cases - Garron and Antle

    STEP Canada was pleased to present its inaugural cross-country webcast on Oct. 27, 2009. The Webcast was watched by 197 attendees via the internet (96% success), and by 43 attendees at the meeting venue in Calgary. The Archived Replay is now available for viewing.

    The topic of this premiere event was the impact of the recently released Tax Court of Canada trust decisions, Garron Family Trust v. The Queen 2009 TCC 450 and Antle v. The Queen 2009 TCC 465. If these decisions are upheld on appeal they will have a significant effect on how existing trusts are structured. STEP Canada brought together a panel of trust experts to provide commentary and field questions about the potential impact of these TCC decisions. The event was broadcast from Calgary’s Metropolitan Conference Centre and webcast across the country.

    Featured Panelists:

    • Craig Jones, Felesky Flynn LLP, Calgary
    • Cindy Radu, CIDEL Trust Company, Calgary
    • David Thompson, Thorsteinssons LLP, Vancouver
    • Prof. Lionel Smith, McGill University Faculty of Law, Montreal
    • Paul LeBreux, Global Tax Law PC, Toronto (Moderator)

    In order to enjoy a successful replay of the Webcast (and for future Webcasts), please note the following Technology Tips:
    • Your firm’s IT department may have highly restrictive firewalls and caching constraints preventing continuous sound and video streaming for an elongated period. You will need to speak to your IT department to ensure those constraints are removed, at least temporarily;
    • Ensure that your PC is set to maximize the viewing access/experience, e.g., ensure your internal sound output is set at a high level, turn up your speakers and turn up the volume control embedded on the Webcast screen;
    • Make sure you only have one Webcast window open at a time;
    • System requirements for the webcast are as follows:
      - Adobe Flash Player 10+ (Update your Flash version at: http://get.adobe.com/flashplayer/ )
      - High-speed broadband internet connection (wired preferred)
      - Modern web browser, such as IE7/8, Firefox 2+, Chrome 1+, or Safari 3+

    Viewing the Archived Replay
    After registering for the Archived Replay, you will receive a confirmation receipt via email. Please click on "National Webcast – ARCHIVED REPLAY" icon on the www.step.ca homepage and follow the screen instructions. Enter your last name, and your STEP order ID number as it appears on your registration receipt. Once your order has been authorized, you will be able to download a PDF file of the Webcast materials (slides and supporting papers) for printing at your location. A password will also be given to you to view the Webcast. Click on the “Click to view Webcast replay” button.

    Note: Registration, via the web, is to be paid on an individual basis. We assume that some viewers will gather together to watch the replay of the webcast together – using only one attendee’s registration access. We are therefore expecting all viewers to honour the effort and expense that STEP Canada has put into bringing you this special event by registering on an individual basis.
